Welcome to www.sineditalia.com. These Terms and Conditions govern your access to and use of this website and the purchase of products from MPC MUSSO PERSONAL COMPUTER S.r.l. (SINED).

By accessing this website, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with these Terms, please do not use this website.

We reserve the right to amend these Terms and Conditions at any time. The version published on the website at the time an order is placed shall apply to that order.

3. Scope of Application

These Terms and Conditions apply to all purchases made through this website by consumers and business customers, whether located within the European Union or internationally.

Nothing in these Terms shall affect any mandatory rights granted to consumers under applicable law.

4. Customer Eligibility

Orders may only be placed by individuals who are at least 18 years of age and legally capable of entering into binding contracts.

Business customers represent that they are authorized to purchase goods on behalf of their company.

5. Product Information, Availability and Pricing

We make every reasonable effort to ensure that product descriptions, specifications, images and prices are accurate.

However:

colours may vary depending on the user’s display;
product dimensions may have normal manufacturing tolerances;
minor technical modifications may occur without prior notice.

All prices are displayed in Euros (€).

Prices include VAT where applicable unless otherwise indicated.

Shipping costs, customs duties and additional charges are calculated separately where applicable.

Product availability is subject to stock.

Should an ordered product become unavailable after an order has been placed, we reserve the right to cancel the order and issue a full refund.

We reserve the right to correct typographical errors, pricing errors or product description inaccuracies at any time, including after an order has been submitted.

6. Orders and Contract Formation

Submitting an order through our website constitutes an offer to purchase the selected products.

The automatic acknowledgement confirming receipt of your order does not constitute acceptance.

A legally binding contract is formed only when we send an Order Confirmation email confirming acceptance of your order.

We reserve the right to refuse or cancel orders for reasons including, but not limited to:

product unavailability;
payment authorization failure;
suspected fraud;
incorrect pricing;
technical errors;
force majeure;
legal or regulatory restrictions.

In the event of cancellation after payment has been received, any amounts paid will be refunded using the original payment method.

7. Payment Methods

Payments may be made using the payment methods available during checkout, including:

Payments are processed through secure third-party payment providers.

SINED does not store complete payment card information.

8. VAT

VAT is charged according to applicable Italian and European tax legislation.

Valid VAT-exempt intra-Community supplies between businesses established within the European Union are processed in accordance with Article 138 of Council Directive 2006/112/EC, provided that a valid VAT Identification Number is supplied and verified before shipment.

Customers remain responsible for providing accurate tax information.

9. Delivery, Shipping and Transfer of Risk

Delivery times are estimates and are not guaranteed unless expressly agreed in writing.

Risk of loss or damage transfers:

to consumers, upon physical delivery of the goods;
to business customers, in accordance with the agreed Incoterms or applicable commercial law.

Customers are requested to inspect the packaging and products immediately upon delivery.

Any visible transport damage should be noted with the carrier upon delivery and reported to us without undue delay.

Customers should retain all packaging materials in the event that a transport claim becomes necessary.

10. Installation

Our products, including outdoor showers, taps and related equipment, should be installed by qualified professionals and in accordance with all applicable local regulations and installation instructions.

SINED shall not be liable for damages arising from:

improper installation;
incorrect maintenance;
unauthorized modifications;
misuse of the products.

11. Right of Withdrawal

Consumers purchasing online have the statutory right to withdraw from the contract within 14 days from receipt of the goods without giving any reason.

The withdrawal procedure, conditions and exceptions are described in our Refund and Returns Policy, which forms an integral part of these Terms and Conditions.

The right of withdrawal does not apply where exclusions provided by applicable law apply, including customized or made-to-order products where legally permitted.

VAT-exempt intra-Community purchases made between businesses established within the European Union (B2B transactions) are excluded from the statutory 14-day right of withdrawal.

In accordance with applicable European consumer protection legislation, the right of withdrawal applies exclusively to consumers and does not extend to business-to-business contracts.

12. Legal Warranty

Consumers benefit from the legal guarantee of conformity provided by Directive (EU) 2019/771 and applicable Italian legislation.

The legal warranty covers defects existing at the time of delivery for a period of two years.

Warranty claims should include:

order number;
product identification;
description of the defect;
photographs where appropriate.

The warranty does not cover damage resulting from:

improper installation;
incorrect maintenance;
accidental damage;
normal wear and tear;
unauthorized repairs or modifications.

Any commercial warranty offered in addition to the statutory warranty shall be governed by its own specific terms.

13. Limitation of Liability

To the maximum extent permitted by applicable law, SINED shall not be liable for indirect, incidental or consequential damages, including loss of profits, business interruption or loss of opportunity arising from the purchase or use of its products.

Nothing in these Terms excludes or limits liability for:

death or personal injury caused by negligence;
fraud or fraudulent misrepresentation;
any liability that cannot legally be excluded under applicable law;
mandatory consumer rights.

14. Force Majeure

SINED shall not be liable for delays or failure to perform its obligations where such delay or failure results from events beyond its reasonable control, including but not limited to:

natural disasters;
fire;
flood;
pandemics;
war;
terrorism;
labour disputes;
transport disruptions;
shortages of raw materials;
governmental actions;
power or communication failures.

15. Intellectual Property

All content on this website, including but not limited to:

trademarks;
logos;
product names;
photographs;
graphics;
videos;
catalogues;
technical drawings;
texts;
software;

is the exclusive property of MPC MUSSO PERSONAL COMPUTER S.r.l. (SINED) or its licensors and is protected by applicable intellectual property laws.

No content may be copied, reproduced, distributed or used without prior written authorization.

16. Customer Accounts

Customers creating an account are responsible for maintaining the confidentiality of their login credentials.

Customers are responsible for all activities carried out under their account and must promptly notify us of any unauthorized access.

17. Privacy

Personal data is processed in accordance with the General Data Protection Regulation (GDPR).

18. International Orders

Orders shipped outside the European Union may be subject to:

customs duties;
import taxes;
local VAT;
customs clearance fees.

These charges are the sole responsibility of the customer and are not included in the purchase price unless expressly stated.

19. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Italy.

Consumers shall benefit from any mandatory consumer protection provisions applicable in their country of residence.

Any disputes that cannot be resolved amicably shall be submitted to the competent courts as provided by applicable law.

Where available under applicable legislation, consumers may also use certified Alternative Dispute Resolution (ADR) bodies.

20. Severability

If any provision of these Terms and Conditions is held to be invalid, unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms and Conditions, together with the Privacy Policy, Cookie Policy and Refund & Returns Policy, constitute the entire agreement between the parties regarding purchases made through this website and supersede all previous communications relating to the same subject matter.
